Goldfish®/MD Back To School Free Gift with Purchase Promotion Official Terms and Conditions

1.Sponsor / Administrator

This Goldfish Back To School Free Gift with Purchase Promotion (the “Promotion”) is sponsored by Campbell Company of Canada (the “Sponsor”) and is being administered on behalf of the Sponsor by MARS-Philter, Inc., d/b/a Mars United, and Elite Digital Inc. (the “Administrators”).

2.Eligibility

The Promotion is open to residents of Canada who are age of majority in their province or territory of residence at the time of participation, who are not an employee, contractor, agent or representative of the Sponsor or Administrators, or their affiliates, agencies, distribution companies, Gift suppliers, fulfillment agencies or any other entity involved in the administration of this Promotion (collectively, the “Promotion Parties”), or a member of the immediate family (parent, spouse, sibling, child) of, or domiciled with any of the foregoing persons.

To be eligible, participants must have online access with a valid email address as of the date of their submission, and must provide a valid Canadian street mailing address that can accept standard delivery or courier delivery. P.O. Boxes are not eligible.

The Promotion is intended for individual consumer use only. Groups, clubs, organizations, commercial or non-commercial entities, resellers and persons participating in a manner that is not consistent with normal consumer purchasing behaviour are not eligible to participate.

If the identity of a participant is disputed, the authorized account holder of the email address submitted at the time of participation will be deemed to be the participant. The individual assigned to the email address by an online service provider, Internet access provider or other organization responsible for assigning the email address for the domain associated with the submitted email address is considered the authorized account holder. A participant may be required to provide the Sponsor or the Administrators with proof that they are the authorized account holder of the email address associated with the submission.

If you participate via a mobile device, you may incur standard data charges from your wireless service provider. Check with your wireless service provider for details on these and other applicable charges. Participants are solely responsible for any such data charges. If you do not have Internet access via a personal computer, your local library or Internet cafe may be able to provide access to the Internet and a number of Internet service providers and other companies offer free email accounts.

3.Purchase Period and Submission Period

The Promotion purchase period starts on July 6, 2026, at 12:00:00 am Eastern Time (“ET”) and ends October 5, 2026, at 11:59:59 pm ET (the “Purchase Period”). The Promotion submission period starts on July 6, 2026, at 12:00:00 am ET and ends October 12, 2026, at 11:59:59 pm ET (the “Submission Period”) at which time all submissions must be received. The Submission Period together with the Purchase Period make up the “Promotion Period”. Qualifying Purchases will not be accepted after the Purchase Period and submissions must be received within the Submission Period.

The sole determinant of the time for the purposes of this Promotion will be the official time keeping device or devices used by the Administrators.

4.How to Participate

Purchase at least three (3) Goldfish®/MD products, including all pack sizes (“Qualifying Products”) during the Purchase Period from any Canadian-located store that sells the Qualifying Products or from a Canadian online retailer or the Canadian website of a retailer selling the Qualifying Products, such that all three (3) Qualifying Products appear on the same receipt (a “Qualifying Purchase”).

To make a submission, visit the Promotion website, which can be found at http://goldfishbacktoschool.ca/ (the “Website”), or scan a QR code in-store, and complete and submit the Promotion submission form, including uploading a photo of the complete receipt showing the Qualifying Purchase, within the Submission Period. Proof of transmission (for example, screenshots) does not constitute proof of receipt.

The photo of the receipt must show the retailer, date, time, purchase price and purchase of at least three (3) Qualifying Products in a single transaction during the Purchase Period. Online purchases are eligible on the same basis as in-store purchases, provided all requirements of these Terms and Conditions are met and the submitted online receipt or order confirmation clearly shows the retailer, order date, Qualifying Products purchased and Canadian delivery or pickup details.

Upon submission of the fully completed Promotion submission form, and subject to verification, compliance with these Terms and Conditions and availability of Gifts, eligible participants will receive one (1) Gift (as described below). Max 3 Gifts per household or email address.

A receipt may only be used one time. Receipts that are altered in any way or bartered, sold, or auctioned will be void. Receipts will be validated before any Gift is awarded.

All submissions must be properly received and recorded by the Administrators’ computer within the Submission Period in order to be eligible. No other form of submitting a request is valid other than as stated above. Multiple participants may not share the same email address. Participants may not participate with multiple email addresses, nor may participants use any other device to participate under multiple identities. Where a participant submits using multiple email addresses or accounts, or otherwise participates under multiple identities, the Administrators reserve the right, in their sole and absolute discretion, to accept only the first valid submission and disregard the others, or, in cases of suspected fraud or bad faith, to disqualify the participant and forfeit any Gift awarded. All submissions become the property of the Sponsor and will not be returned.

5.Gift Description

Each verified Qualifying Purchase submitted in accordance with these Terms and Conditions will receive one (1) Gift consisting of one (1) Goldfish-branded whiteboard planner (8.5x11”) with 4.5” marker and one (1) coupon for a free (maximum value $5) participating Goldfish®/MD Grahams product, subject to coupon terms and expiry date printed on the coupon (each a “Gift”).

Sponsor reserves the right to substitute a Gift or any component of a Gift with an item of equal or greater value, including if the advertised Gift or any component becomes unavailable for any reason.

The Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any Gift, except as may be required by applicable law. The Sponsor and Administrators are not responsible for any Gift once it has been sent. The replacement of a missing Gift is at the sole and absolute discretion of the Sponsor.

6.Gift Details

Gifts will be allocated to eligible participants in the order in which valid submissions are received and successfully validated by or on behalf of the Sponsor.

Limit of three (3) Gifts per household during the Promotion Period, in compliance with these Terms and Conditions. For the purposes of these Terms and Conditions, “household” means all persons residing at the same mailing address. Limit of one (1) Gift per valid receipt, regardless of the number of Qualifying Purchases shown on that receipt. For example, if a receipt shows the purchase of six (6) Qualifying Products that would otherwise constitute two (2) potential Qualifying Purchases, only one (1) Gift will be issued for that receipt.

Multiple receipts may be submitted by the same individual or household, provided each receipt documents at least one (1) Qualifying Purchase, has not been previously used in this Promotion or any other promotion, complies with these Terms and Conditions and does not cause the household to exceed the limit of three (3) Gifts during the Promotion Period.

The Sponsor and Administrators reserve the right, in their sole and absolute discretion, to reject or invalidate any submissions or receipts that appear to be bulk, group or commercial in nature, that appear to involve receipt reuse, manipulation or automated submission activity, or that are not in keeping with the letter and spirit of the Promotion.

7.Processing, Verification and Receipt Validation

Processing of submissions will typically take up to 10 business days from the date the submission is received by or on behalf of the Sponsor. Processing times may vary and may be longer due to high volume, additional verification needs or other circumstances. No responsibility is accepted for delays in processing, and no separate notice of extended processing times will be sent.

Following processing, the participant may receive an email notification advising that the submission has been successfully validated and a Gift will be issued, or that the submission could not be validated and, where permitted, a brief description of the issue and whether the participant may resubmit a corrected image while the Promotion remains open and Gifts remain available.

The Sponsor and Administrators reserve the right, in their sole and absolute discretion, to require at any time the original paper receipt or proof of online purchase, additional documentation or information, and/or proof of identity, age and address, such as government issued photo identification, for the purposes of verifying eligibility and compliance with these Terms and Conditions. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified may result in disqualification.

Receipts will be rejected and submissions may be void if, in the sole and absolute discretion of the Sponsor or Administrators, they fail to pass anti-fraud, security or validation checks, are illegible, unreadable, incomplete, altered, damaged or blank, do not clearly identify the retailer, date, time, Qualifying Products and purchase prices, show Qualifying Products that are refunded, returned or exchanged, show the use of unauthorized or fraudulent coupons, rebates or discounts, contain store-level or system errors, price look-up codes, or other markings that may indicate they are not legitimate consumer receipts, have been previously used in this Promotion or any other promotion, are duplicates of another receipt submitted in this Promotion, including where the same receipt has been submitted by more than one person, or are identified by the Sponsor or Administrators as fake, unauthorized, obtained through illegitimate channels, or otherwise not in compliance with these Terms and Conditions.

8.Delivery of Gifts

Participants whose submissions are validated and who are confirmed as eligible will have their Gifts fulfilled as follows:

  • Gifts will be shipped by or on behalf of the Administrators to the Canadian street mailing address provided by the participant at time of registration. P.O. Boxes are not eligible.
  • Participants should allow approximately 4 to 6 weeks after the Submission Period closes for delivery of the Gift. Delivery times may be longer to remote or rural areas. In the event of an unanticipated high response to the Promotion, fulfillment of Gifts may be delayed. In such case, affected participants will receive an email notification regarding the delay.

No responsibility is accepted by the Sponsor or the Administrators for late, lost, stolen, damaged, misdirected, mutilated, delayed or undeliverable Gifts or communications, whether caused by postal or courier issues, incorrect or incomplete address information, or otherwise, any Gift once it has been handed over to the postal service or courier, or any inability of a participant to accept or receive a Gift for any reason.

Gifts that are unclaimed, undeliverable or returned as undeliverable may not be re-sent, and may be forfeited.

9.Additional Conditions of Participation

By participating in this Promotion, participant accepts and agrees to these Official Terms and Conditions and all decisions of the Sponsor and Administrators, which shall be final and legally binding on participant in all matters relating to this Promotion. All submissions become the property of the Sponsor and will not be returned.

Participants assume liability for damages or injuries caused or claimed to be caused by participating in the Promotion, by the acceptance, possession, use or misuse of any Gift awarded, including but not limited to claims/damages for personal injury, or property damage.

Moreover, as a condition of participating, participants agree to release the Promotion Parties, the Administrators, and each of their officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to participating in the Promotion or the awarding, receipt, possession, and/or use or misuse of any Gift.

The Sponsor and its respective affiliates are not responsible for printing, technical errors, distribution, or production errors. The Promotion Parties do not warrant that access to, or use of the Promotion will be uninterrupted or error-free.

Sponsor reserves the right to disqualify any individual from further participation in the Promotion if Sponsor concludes, in its sole discretion, that such person: (a) has attempted to tamper with the submission process or other operation of the Promotion; (b) has failed to comply with or has attempted to circumvent these Terms and Conditions; (c) has committed fraud or attempted to undermine the legitimate operation of the Promotion, including by using automated systems, scripts, bots or other means to submit or generate submissions; or (d) has acted toward Sponsor, any Promotion Party, or any other participant in an unfair, inequitable, annoying, threatening, disrupting, or harassing manner.

If a dispute arises regarding compliance with these Terms and Conditions, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor’s control, but Sponsor will not be obligated to consider any data or other information collected from any other source.

10.Events Interfering with Promotion Administration

The Sponsor may, at their sole discretion and without liability to Promotion participants, terminate the Promotion in whole or in part, or modify or suspend the Promotion at any time without notice in the event any situation arises in the Sponsor’s sole opinion that impedes or prevents the Sponsor’s ability to administer the Promotion as planned or intended by an event beyond the Sponsor’s control, including but not limited to an act of God, fire, flood, pandemic, natural or manmade epidemic or crisis, earthquake, explosion, labour dispute or strike, telecommunications equipment failure, utility-related disruptions, software viruses, software bugs, computer programming errors, terrorist threat or activity, war, any federal, provincial, territorial or local government law, order or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor’s control.

11.Release

By participating in this Promotion, all participants declare that they have read, understood and complied with these Terms and Conditions, agree to abide by all decisions by the Sponsor, which are final, and agree to release, indemnify and hold harmless the Promotion Parties, and each of their affiliates, directors, officers, employees, professional advisors and advertising and promotional agencies (collectively, the “Released Parties”) from any injuries, liability, losses and damages of any kind to persons or property, in whole or in part, directly or indirectly, in connection with participating in this Promotion and/or any Gift awarded.

For greater certainty, the “Released Parties” include, without limitation, the Promotion Parties. None of the Released Parties will be liable to you under tort, contract, strict liability, negligence or any other legal or equitable theory, for any loss or damages of any kind, including, without limitation, for any direct, indirect, economic, exemplary, special, punitive, incidental or consequential losses or damages.

Damages, if any, caused to you are not irreparable or sufficient to entitle you to an injunction preventing any exploitation of any website, service, property, product or other content owned or controlled by Sponsor, and you will have no rights to enjoin or restrain the development, production, distribution, advertising, exhibition or exploitation of any website, property, product, service, or other content owned or controlled by Sponsor.

Sponsor is not responsible for the actions, content, information, or data of third parties, and you release Sponsor and Sponsor’s officers, directors, shareholders, employees, agents, suppliers, partners and representatives from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such parties.

You shall further defend, indemnify, and hold harmless Sponsor and the Promotion Parties and their respective affiliates and each of its and their respective officers, directors, shareholders, employees, agents, suppliers, partners and representatives of the foregoing from all losses, costs, actions, claims, damages, expenses, including reasonable legal costs, or liabilities, that arise from or relate to your use or misuse of, or access to, the Website or otherwise from your violation of these Terms and Conditions, or infringement by you, or any third-party using your account, of any intellectual property or other right of any person or entity.

Sponsor reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with Sponsor in asserting any available defenses.

The Released Parties are not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions including lost, misappropriated or corrupted submissions, virus, worm or Trojan Horse damage or any other damage which may limit a participant’s ability to participate in the Promotion.

12.General

All decisions of the Sponsor shall be final. The Sponsor is not responsible for errors in the offer or administration of this Promotion, including but not limited to, errors in the advertising, these Terms and Conditions or the distribution of any Gift. The Promotion is subject to all applicable federal, provincial, municipal and local laws. The Sponsor reserves the right to modify or terminate this Promotion at any time without notice to participants. Any failure by Sponsor to enforce any of these Terms and Conditions will not constitute a waiver of such Terms and Conditions.

13.Privacy

The Sponsor respects your right to privacy.

Information collected from participants will be used for the purpose of administering this promotion, internal data analytics, marketing purposes and for any additional purposes in accordance with Sponsor’s Privacy Policy at https://www.campbellsoupcompany.com/privacy-policy/.

14.Disputes

All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of participant and the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to conflicts of law principles. All participants consent to the jurisdiction and venue of the Province of Ontario. All causes of action arising out of or connected with this Promotion, or any Gift awarded, shall be resolved individually, without resort to any form of class action, nor arbitration.

15.Conflicts / Discrepancies

In the event of a conflict between any Promotion details contained in these Terms and Conditions and any Promotion details contained in Promotion marketing or advertising materials, including, but not limited to, online, point of sale, television, and print advertising, promotional packaging, and other promotion media, the details of the Promotion as set forth in these Terms and Conditions shall prevail.

16.Invalidity

The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
